License Agreement and Disclaimer

Please, read the license agreement and disclaimer below. We ("Solid Iris") host here the files, documents and any other data ("Material") that have been created by an author ("Author Party") to be downloaded and used by others ("User Party"), free of charge.


FOR THE AUTHOR PARTY THAT UPLOADS MATERIAL

The Author Party agrees that it holds the copyrights for uploading any material here and it is the sole creator of this Material.

By uploading any Material, the Author Party agrees that it does not infringe, or constitute an infringement or misappropriation of, any patent, copyright, trademark or similar proprietary rights conferred by contract or by common law.

The Author Party agrees that the Material uploaded can be used under the license agreement found below.


FOR THE USER PARTY THAT DOWNLOADS AND USES THE MATERIAL

1. License and Terms of Usage

You are granted a personal, non-transferable, and non-exclusive license to download, install and use any Material found in this section. The license is given free of charge and can be used for any purposes (including commercial).

2. Restrictions on Use

Unless otherwise agreed separately in writing with the AUTHOR PARTY or under a separate license agreement between USER and AUTHOR PARTY, you agree that you will NOT:

- Sell, license, sub-license, transfer, assign, re-distribute, lend, lease or rent (including via a timeshare arrangement), the material, its use, or the license granted by this agreement.

- Items in the licensed user club section can only be used by licensed Thea users.

3. Ownership and Intellectual Property

The Author Party is the owner of all intellectual property relating to the Material for which the license is granted. The Author Party owns and retains all copyright, trademark, and other proprietary rights in and to the Material unless otherwise stated.

You agree to maintain in good condition any property notices, labels, trademarks, copyright symbols, or any other property indications in the Material indicating that Author Party is the owner.

4. Disclaimer of Warranty

The Material is provided “AS IS” and without warranty or condition of any kind. The Author Party and Solid Iris specifically disclaim, including but not limited to, the express or implied warranties or conditions of merchantable quality and fitness for a particular purpose. The Author Party and Solid Iris do not warrant that the Material will meet your requirements, or that it can carry out any specific function, or that the operation of the Material will be uninterrupted or error free.

In no event shall the Author Party or Solid Iris be liable to you or any third party for any direct, indirect, special, incidental, punitive or consequential damages (including but not limited to damages resulting from loss of use, loss of data, loss of profits, loss of goodwill, and loss of business), arising out of, or in connection with, the use of, or inability to use, or low performance of, the Material or documentation, even if the Author Party or Solid Iris have been advised of the possibility of such damages.
